Privacy Policy - Australia

Last updated: 27 September 2026

1. Who we are

This Privacy Policy explains how we collect, use, store, disclose and protect your personal information when you visit our websites, subscribe to our emails, purchase our products, or use any of our services.

It applies to:

  • Silence My Ears — silencemyears.com (our main website)
  • Silence Tinnitus Now — silencetinnitusnow.com
  • Liam Stops Tinnitus — liamstopstinnitus.com

All three are operated by Liam Boehm ("we", "us", "our"), trading in Australia.

We take your privacy seriously. Because our work touches on your health, we treat the information you share with us with particular care.

Privacy enquiries: support@silencemyears.com

2. The law we follow

We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles ("APPs").

Because our services relate to a health condition, we treat information you give us about your tinnitus, symptoms, medical history, medications and general health as sensitive information and, where applicable, health information under the Privacy Act. Sensitive information attracts a higher standard of protection, and we apply that standard regardless of whether we are strictly required to.

Where you are located in the European Union or United Kingdom, we also seek to comply with the General Data Protection Regulation. Where you are a California resident, see section 16.

3. What personal information we collect

3.1 Information you give us directly

  • Identity and contact details — your name, email address, and where you provide it, your phone number, country and postal address.
  • Purchase information — what you bought, when, the amount, your order reference, and your billing country. Full payment card numbers are handled by our payment providers and are never stored on our systems.
  • Health and symptom information — where you choose to provide it through an intake form, questionnaire, survey, coaching booking or email. This may include the nature and duration of your tinnitus, related symptoms, diagnoses, test results you describe to us, medications and supplements, diet, sleep, stress levels and lifestyle factors.
  • Correspondence — the content of emails, support messages, survey responses and coaching notes.
  • Account details — where you create an account, your login credentials in encrypted form.

3.2 Information we collect automatically

  • Technical data — IP address, browser type and version, operating system, device type, screen size, language and referring website.
  • Usage data — pages viewed, time on page, scroll depth, clicks, video watch time and how far through a video you reached, form interactions, and the path you take through our site.
  • Marketing data — the campaign, ad, keyword or link that brought you to us, including UTM parameters and click identifiers.
  • Email engagement — whether an email was delivered, opened, and which links were clicked.

3.3 Information from third parties

  • Advertising and analytics platforms, which may provide aggregated or attributed campaign data.
  • Payment providers, which confirm the outcome of a transaction.
  • Where you engage with us on a social platform, information you have made available on that platform.

4. Why we collect it, and our lawful basis

We collect and use your personal information to:

  • Deliver the products and services you purchase — To perform our contract with you
  • Prepare personalised plans and coaching — With your consent, based on what you tell us
  • Provide customer support and process refunds — To perform our contract and meet legal obligations
  • Send educational content and marketing emails — With your consent, which you can withdraw at any time
  • Improve our content, website and products — Our legitimate interest in running and improving the business
  • Measure advertising performance — Our legitimate interest, and consent where required
  • Prevent fraud, abuse and security incidents — Our legitimate interest and legal obligations
  • Meet tax, accounting and legal requirements — Legal obligation

We do not sell your personal information.

5. Health and sensitive information

This section explains how we treat the most sensitive category of information you may share with us.

5.1 We only collect it with your consent

We collect health information only where you voluntarily provide it — for example, by completing an intake questionnaire, booking a coaching session, replying to a survey, or telling us about your situation by email. You are never obliged to share it. If you would rather not, you can still buy and use our general educational products.

5.2 What we use it for

We use health information solely to:

  • prepare and personalise a plan or recommendation for you;
  • answer your questions accurately;
  • understand, in aggregate and de-identified form, which approaches help which kinds of people.

5.3 What we will not do with it

  • We will not sell it.
  • We will not disclose it to advertisers, or use it to target advertising to you.
  • We will not upload it to any advertising platform, including as part of a custom audience.
  • We will not share it with your employer, insurer or any third party, except as set out in section 7 or where you ask us to.

5.4 It is not a medical record

Information you give us is used for coaching and education. It is not a clinical record, we are not a health service provider in the clinical sense, and it is not a substitute for the records held by your own doctor. Please see our Terms and Conditions for what our services are and are not.

6. Cookies, tracking and analytics

6.1 Anonymous counting (always on)

We count how our pages are used — pages viewed, how far down a page people scroll, which buttons are clicked and how much of a video is watched — so we can fix what isn’t working. When you haven’t agreed to cookies, this counting is anonymous: nothing is stored on your device, the number that groups a single page view together exists only while that page is open, and nothing is linked to you, your email or any other visit. Our website host also counts how many times each page is sent, per hour, with no information about who asked for it.

6.2 Cookies we use with your agreement

If you choose Accept, we also use first-party cookies and local storage to remember that it’s you from page to page, to link your visit to the email you give us when you sign up, and to tell whether you watched our videos. We use that so the emails we send you are relevant — for example, not asking you to watch a video you already have.

6.3 Advertising

If you choose Accept, our pages also load a tag from our advertising partner Taboola. It records that you visited, and whether you signed up, started checkout or bought and for how much, so Taboola can measure and improve our ads. Taboola may set its own cookies and handles that information under its own privacy policy. We never send health information to Taboola. We do not use the Meta (Facebook) pixel or Google advertising or analytics tags.

6.4 Your choices

When you first visit, we ask whether you accept cookies. Choosing No thanks means none of the cookies in 6.2 or 6.3 are set, nothing is linked to you and nothing is shared with Taboola; only the anonymous counting in 6.1 continues. Your choice is remembered on your device for 180 days, and you can change it at any time from the Your privacy choices link at the foot of every page. You can also block or delete cookies in your browser settings.

6.5 The cookies we use

  • _ft_consent / ftconsent — remembers your cookie choice (180 days).
  • _ft_ccseen — stops the cookie notice reappearing on every page (until you close your browser).
  • ftab_… — keeps showing you the same version of a page we are testing (30 days).
  • _ft_vid, _ft_sid, _ft_visits, _ft_first — recognise your visit from page to page (only if you Accept; 180 days, or the session).
  • _ft_src, _ft_lead — where you came from, and your email once you sign up (only if you Accept; 180 days).
  • _ftpos_… — where you stopped a video, so it can resume (only if you Accept; until the video ends).
  • Taboola cookies — advertising measurement (only if you Accept; set by Taboola).

Most of these are also kept in your browser’s local storage, which has no expiry date and stays until you clear your browsing data. Choosing No thanks or opting out deletes our visitor, source, email and visit-count entries straight away.

7. Who we share your information with

We share personal information only as follows:

7.1 Service providers

We use third parties to run the business. Each acts on our instructions and under its own privacy obligations:

  • Payment processing — to take payment and process refunds.
  • Website and application hosting — to serve our sites and store data.
  • Email delivery — to send transactional and marketing email.
  • Video hosting — to deliver course and sales videos.
  • Analytics and advertising platforms — to measure traffic and campaign performance.
  • Scheduling and support tools — to book sessions and manage enquiries.

7.2 Professional advisers

Our accountant, bookkeeper or legal advisers, where reasonably necessary and under a duty of confidentiality.

7.3 Legal and safety

We may disclose information where required by law, court order or a lawful request from a government or regulatory body, or where we reasonably believe disclosure is necessary to prevent a serious threat to a person's life, health or safety.

7.4 Business transfer

If the business is sold or restructured, information may be transferred as part of that transaction. We would take reasonable steps to ensure the recipient continues to protect it under terms no less protective than this Policy.

8. Overseas disclosure

Some of our service providers store or process data outside Australia, including in the United States and the European Union.

Before disclosing personal information overseas, we take reasonable steps to ensure the recipient handles it consistently with the APPs — normally by relying on the provider's contractual data-protection commitments. You should be aware that data protection laws in other countries may differ from those in Australia.

9. How we store and protect your information

We hold personal information in secure, access-controlled systems. Protections include encryption in transit (HTTPS/TLS), encryption of stored credentials, database-level access controls, and restricting access to those who need it.

No system is perfectly secure. While we take reasonable steps to protect your information, we cannot guarantee absolute security. If a data breach occurs that is likely to result in serious harm, we will notify you and the Office of the Australian Information Commissioner as required under the Notifiable Data Breaches scheme.

10. How long we keep it

  • Marketing contact details — until you unsubscribe or ask us to delete them, and then only as needed to honour your opt-out.
  • Purchase and transaction records — at least seven years, as required by Australian tax law.
  • Health and coaching information — for as long as needed to provide the service and a reasonable period afterwards, then deleted or de-identified.
  • Analytics data — normally in de-identified or aggregated form after 26 months.

Where information is no longer needed and we are not required to keep it, we destroy or de-identify it.

11. Direct marketing and how to opt out

When you subscribe, buy from us, or ask for a free resource, we may send you educational content and marketing emails.

Every marketing email contains a clear unsubscribe link. Unsubscribing takes effect immediately and stops all marketing email. You may still receive transactional messages relating to a purchase, such as a receipt or access details.

You can also opt out at any time by emailing support@silencemyears.com.

We comply with the Spam Act 2003 (Cth), including its requirements for consent, sender identification and a functional unsubscribe facility.

12. Accessing and correcting your information

You may ask us to:

  • confirm what personal information we hold about you;
  • give you a copy of it;
  • correct anything inaccurate, out of date, incomplete or misleading;
  • delete it, where we are not required by law to keep it.

Email support@silencemyears.com. We will respond within a reasonable time, normally within 30 days. We may need to verify your identity first. Access is free; if a request is unusually complex we may discuss a reasonable cost with you before proceeding.

In limited circumstances we may refuse access or correction — for example where it would unreasonably affect another person's privacy. If we refuse, we will tell you why in writing and explain how to complain.

13. Anonymity

Where it is lawful and practicable, you may deal with us anonymously or under a pseudonym — for example, when asking a general question. We cannot deliver a purchased product, provide personalised coaching or process a refund without identifying information.

14. Children

Our services are directed to adults and are not intended for children under 18. We do not knowingly collect personal information from a child under 18. If you believe a child has given us personal information, contact us and we will delete it.

15. If you are in the EU or UK

Where the GDPR applies to you, you also have the right to object to processing, to restrict processing, to data portability, and to withdraw consent at any time without affecting the lawfulness of processing before withdrawal. You may lodge a complaint with your local supervisory authority.

Where we rely on consent to process special-category data such as health information, that consent is explicit and you may withdraw it at any time by contacting us.

16. If you are a California resident

Under the CCPA/CPRA you have the right to know what personal information we collect, use and disclose, to request deletion, to request correction, and to be free from discrimination for exercising those rights.

We do not sell or share personal information as those terms are defined under the CCPA. To make a request, email support@silencemyears.com.

17. Complaints

If you think we have mishandled your personal information, please tell us first at support@silencemyears.com. We take complaints seriously and will investigate and respond, normally within 30 days.

If you are not satisfied with our response, you may complain to:

Office of the Australian Information Commissioner (OAIC)
Website: oaic.gov.au
Phone: 1300 363 992
Post: GPO Box 5218, Sydney NSW 2001

18. Changes to this Policy

We may update this Policy from time to time. When we make material changes we will update the "Last updated" date and, where appropriate, notify you by email or by notice on our website. The current version is always available on our websites.

Privacy Policy — United States

Applies to residents of the United States
Last updated: 27 September 2026

Which version applies to you. This policy applies if you are located in the United States. Customers in Australia, the European Union, the United Kingdom and other regions are covered by the privacy policy for their region, also published on this website.

1. Who we are

This Privacy Policy explains how we collect, use, disclose and protect your personal information when you visit our websites, subscribe to our emails, purchase our products, or use our services.

It applies to:

  • Silence My Ears — silencemyears.com (our main website)
  • Silence Tinnitus Now — silencetinnitusnow.com
  • Liam Stops Tinnitus — liamstopstinnitus.com

All three are operated by Liam Boehm ("we", "us", "our"), an Australian business.

Privacy contact: support@silencemyears.com

2. Two things to know up front

2.1 HIPAA does not apply — but other laws do

We are not a HIPAA covered entity or business associate. Information you share with us about your tinnitus or health is not protected health information under HIPAA.

That does not mean it is unprotected. Several US state laws apply directly to it, including Washington's My Health My Data Act, Nevada SB 370, and the health-data provisions of state comprehensive privacy laws. We treat health information as sensitive and handle it accordingly. See Section 6.

2.2 Selling and sharing

We do not sell your personal information for money. We do use an advertising partner, Taboola, which receives information about your visits to our pages to measure and improve our ads. Under some state laws, including California’s, this can count as “sharing” personal information or “targeted advertising”, and you have the right to opt out. You can do that at any time with the Your privacy choices link at the foot of every page, and if your browser sends a Global Privacy Control signal we treat it as an opt-out automatically. We never share health information with Taboola or any other advertising partner.

3. What we collect

3.1 Information you give us

  • Identifiers — name, email address, and where provided, phone number, country, state and postal address.
  • Commercial information — products purchased, purchase dates, amounts, order references, billing country. Full card numbers are handled by our payment processors and never stored by us.
  • Health information — where you choose to provide it through an intake form, questionnaire, survey, coaching booking or email. This may include the nature and duration of your tinnitus, related symptoms, diagnoses, test results you describe, medications and supplements, diet, sleep, stress and lifestyle factors.
  • Communications — emails, support messages, survey responses and coaching notes.
  • Account credentials — in encrypted form.

3.2 Information collected automatically

  • Internet activity — IP address, browser type and version, operating system, device type, screen size, language, referring site, pages viewed, time on page, scroll depth, clicks, video watch time and how far into a video you reached, and form interactions.
  • Marketing data — the campaign, ad or link that brought you to us, including UTM parameters and click identifiers.
  • Email engagement — delivery, opens and link clicks.
  • Approximate location — inferred from IP address. We do not collect precise geolocation.

3.3 Information from third parties

Advertising and analytics platforms may provide aggregated or attributed campaign data. Payment processors confirm transaction outcomes.

3.4 Categories under the CCPA

In the past twelve months we have collected these CCPA categories: identifiers; commercial information; internet or other electronic network activity information; approximate geolocation data; and sensitive personal information (health information you voluntarily provide). We have not collected biometric information, precise geolocation, or information about criminal history.

4. Why we collect it

  • Deliver what you purchased — Provide access, fulfil orders, support you
  • Personalise coaching and plans — Only using information you choose to give us
  • Customer support and refunds — Answer questions, process guarantees
  • Marketing email — Educational content and offers, with opt-out in every message
  • Improve products and content — Understand what helps, in aggregate
  • Measure advertising — Attribute conversions, control ad spend
  • Security and fraud prevention — Protect accounts and detect abuse
  • Legal and tax compliance — Meet record-keeping obligations

5. How long we keep it

  • Marketing contact details — until you unsubscribe or ask for deletion, then only as needed to honour your opt-out.
  • Purchase and transaction records — at least seven years for tax and accounting.
  • Health and coaching information — for as long as needed to provide the service and a reasonable period after, then deleted or de-identified.
  • Analytics data — normally de-identified or aggregated after 26 months.

6. Consumer health data — Washington, Nevada and beyond

This section serves as our Consumer Health Data Privacy Policy for the purposes of the Washington My Health My Data Act and Nevada SB 370.

6.1 What consumer health data we collect

Only what you voluntarily provide: information about your tinnitus and hearing, related symptoms, diagnoses you tell us about, medications and supplements you mention, and lifestyle factors relevant to a plan — diet, sleep, stress. We also collect the fact that you purchased a tinnitus-related product, which may itself constitute consumer health data.

6.2 How we collect it

Directly from you, through forms, surveys, coaching bookings and email. We do not infer health conditions from your browsing behaviour, and we do not buy health data from data brokers.

6.3 Why we collect it

Solely to deliver the education and coaching you asked for, to personalise a plan, to answer your questions accurately, and — in de-identified and aggregated form — to understand which approaches help which kinds of people.

6.4 Who we share it with

We share consumer health data only with the service providers strictly necessary to deliver the service to you — our hosting, email and scheduling providers — each under contract and acting on our instructions.

We do not sell consumer health data. We have never sold consumer health data, and we will not do so. Selling consumer health data requires a signed authorisation under Washington law, and we do not seek one.

We do not use consumer health data for advertising, and we do not upload it to any advertising platform, including as part of any custom or lookalike audience.

6.5 Your rights over consumer health data

You have the right to confirm whether we collect, share or sell your consumer health data; to access it; to withdraw consent to its collection and sharing; and to have it deleted, including by our service providers. Email support@silencemyears.com. We respond within 45 days, extendable once by a further 45 days where reasonably necessary, and will tell you if we need the extension.

6.6 Geofencing

We do not operate any geofence around a healthcare facility, and we will not.

7. Cookies, tracking and advertising

Measuring our pages. We use first-party cookies and local storage to understand how our pages are used — pages viewed, scrolling, clicks and how much of a video is watched — and to recognise you from page to page and link your visit to your email once you sign up, so our emails can be relevant to you.

Advertising. Our pages load a tag from Taboola. It records your visit and whether you signed up, started checkout or bought and for how much, so Taboola can measure and improve our ads. Taboola may set its own cookies and processes that information under its own privacy policy. We do not use the Meta (Facebook) pixel or Google advertising or analytics tags.

Your choices. Use Your privacy choices at the foot of any page to opt out. Opting out, or sending a Global Privacy Control signal, stops the Taboola tag loading and stops us linking your visits to you; after that we only count page views anonymously — nothing stored on your device, nothing linked to you. Your opt-out is remembered on your device for 180 days. You can also block or delete cookies in your browser. Our website host counts how many times each page is sent, with no information about who asked for it.

The cookies we use:

  • _ft_consent / ftconsent — remembers your cookie choice (180 days).
  • _ft_ccseen — stops the cookie notice reappearing on every page (until you close your browser).
  • ftab_… — keeps showing you the same version of a page we are testing (30 days).
  • _ft_vid, _ft_sid, _ft_visits, _ft_first — recognise your visit from page to page (unless you opt out; 180 days, or the session).
  • _ft_src, _ft_lead — where you came from, and your email once you sign up (unless you opt out; 180 days).
  • _ftpos_… — where you stopped a video, so it can resume (unless you opt out; until the video ends).
  • Taboola cookies — advertising measurement (unless you opt out; set by Taboola).

Most of these are also kept in your browser’s local storage, which has no expiry date and stays until you clear your browsing data. Choosing No thanks or opting out deletes our visitor, source, email and visit-count entries straight away.

8. Who we disclose to

  • Service providers — payment processing, hosting, email delivery, video hosting, analytics, advertising measurement, scheduling and support. Each acts on our instructions under contract.
  • Professional advisers — accountant, bookkeeper or lawyers, under confidentiality.
  • Legal and safety — where required by law, subpoena, court order or lawful government request, or where necessary to prevent a serious threat to a person's life, health or safety.
  • Business transfer — if the business is sold or restructured, information may transfer as part of that transaction under terms no less protective.

9. Your rights under US state privacy laws

Depending on where you live, you may have some or all of the following rights. We honour these rights for all US residents, regardless of whether your state has passed a comprehensive privacy law.

  • Know / access — what we collect, use and disclose, and a copy of your information.
  • Delete — request deletion, subject to legal retention requirements.
  • Correct — fix inaccurate information.
  • Portability — receive your data in a portable format.
  • Opt out of sale or sharing — we do not sell or share, but the right stands.
  • Limit use of sensitive personal information — we already limit health information to delivering the service you asked for.
  • Non-discrimination — we will not deny service, charge a different price, or provide a lesser standard of service because you exercised a privacy right.
  • Appeal — if we deny a request, you may appeal by replying to our decision. If we deny the appeal, we will tell you how to contact your state attorney general.

9.1 How to make a request

Email support@silencemyears.com with the request and the email address you use with us. We will verify your identity, normally by confirming details we already hold. We respond within 45 days, extendable once by a further 45 days where reasonably necessary.

9.2 Authorised agents

You may use an authorised agent. We will require written proof of authorisation and may still ask you to verify your identity directly.

9.3 California — additional disclosures

California residents may also request the specific pieces of personal information we hold and the categories of sources, purposes and third parties involved. Those categories are set out in Sections 3, 4 and 8 above. California's "Shine the Light" law does not apply to us because we do not disclose personal information to third parties for their own direct marketing purposes.

10. Security

We hold personal information in secure, access-controlled systems. Protections include encryption in transit (HTTPS/TLS), encryption of stored credentials, database-level access controls, and limiting access to those who need it.

No system is perfectly secure. We cannot guarantee absolute security. Where a breach occurs that triggers notification obligations under applicable state law, we will notify affected individuals and regulators as required.

11. Email and marketing

Every marketing email includes an unsubscribe link, honoured promptly, in compliance with the CAN-SPAM Act. You may still receive transactional messages relating to a purchase, such as receipts and access details. You can also opt out by emailing support@silencemyears.com.

12. Children

Our services are directed to adults and not intended for anyone under 18. We do not knowingly collect personal information from children under 13, consistent with COPPA, or from minors under 16 for sale or sharing. If you believe a child has given us information, contact us and we will delete it.

13. International transfer

We are an Australian business. Information you provide is transferred to and processed in Australia, the United States and the European Union, depending on the provider. By using the Services you understand that your information will be processed outside the United States, where privacy laws may differ.

14. Changes to this Policy

We may update this Policy. When we make material changes we will update the "Last updated" date and, where appropriate, notify you by email or website notice. The current version is always available on our websites.

Privacy Policy — European Union and United Kingdom

Applies to individuals in the EU, EEA, Switzerland and the United Kingdom Last updated: 27 September 2026

Which version applies to you. This policy applies if you are in the EU, EEA, Switzerland or the UK. Individuals elsewhere are covered by the privacy policy for their region, also published on this website.

1. Controller and contact details

The data controller for the personal data described in this policy is:

Liam Boehm Trading as Silence My Ears (silencemyears.com), Silence Tinnitus Now (silencetinnitusnow.com) and Liam Stops Tinnitus (liamstopstinnitus.com) Australia

Email for all data protection matters: support@silencemyears.com

2. What this policy covers

This policy explains what personal data we collect, why, on what legal basis, who we share it with, how long we keep it, and what rights you have. It is written to satisfy Articles 13 and 14 of the GDPR and UK GDPR.

3. The personal data we process

3.1 Data you give us

  • Identity and contact — Name, email address, and where provided phone number, country, postal address
  • Transaction — Products purchased, dates, amounts, order references, billing country. Card numbers are handled by our payment processors and never stored by us
  • Health data (special category) — Where you choose to provide it: nature and duration of your tinnitus, related symptoms, diagnoses, test results you describe, medications and supplements, diet, sleep, stress and lifestyle factors
  • Correspondence — Emails, support messages, survey responses, coaching notes
  • Account — Login credentials, stored in encrypted form

3.2 Data collected automatically

Technical data (IP address, browser, operating system, device type, screen size, language, referring site); usage data (pages viewed, time on page, scroll depth, clicks, video watch time and depth reached, form interactions); marketing data (campaign, ad or link that brought you to us, including UTM parameters and click identifiers); and email engagement (delivery, opens, link clicks).

3.3 Data from third parties

Aggregated or attributed campaign data from advertising and analytics platforms, and transaction outcomes from payment processors.

4. Purposes and legal bases

  • Deliver the products and services you purchased — Contract — Art 6(1)(b)
  • Customer support, refunds, honouring the guarantee — Contract — Art 6(1)(b)
  • Prepare personalised plans and coaching using health data — Explicit consent — Art 6(1)(a) and Art 9(2)(a)
  • Send marketing email — Consent — Art 6(1)(a), withdrawable at any time
  • Non-essential cookies and advertising measurement — Consent — Art 6(1)(a), via our cookie banner
  • Improve our content, website and products — Legitimate interests — Art 6(1)(f)
  • Security, fraud prevention, protecting our systems — Legitimate interests — Art 6(1)(f)
  • Tax, accounting and record-keeping — Legal obligation — Art 6(1)(c)

Where we rely on legitimate interests, we have assessed that our interest in running, securing and improving the business does not override your rights and freedoms. You may object at any time — see Section 9.

5. Health data — special category data

This is the most sensitive data we handle and it is treated separately.

5.1 We process it only with your explicit consent

We process health data only where you voluntarily provide it and have given explicit consent under Article 9(2)(a) — for example by completing an intake questionnaire, booking coaching, replying to a survey, or telling us about your situation by email.

You are never obliged to share it. If you would rather not, you can still buy and use our general educational products.

5.2 What we use it for

Solely to prepare and personalise a plan for you, to answer your questions accurately, and — in de-identified, aggregated form — to understand which approaches help which kinds of people.

5.3 What we will never do with it

  • We will not sell it.
  • We will not disclose it to advertisers or use it to target advertising.
  • We will not upload it to any advertising platform, including as part of any custom or lookalike audience.
  • We will not share it with your employer, insurer or any third party, except as set out in Section 7 or where you ask us to.

5.4 Withdrawing consent

You may withdraw consent at any time by emailing support@silencemyears.com. Withdrawal does not affect the lawfulness of processing before withdrawal. If you withdraw consent we will delete your health data unless we are legally required to retain it, and we may no longer be able to provide personalised coaching.

5.5 No automated decision-making

We do not make decisions producing legal or similarly significant effects about you based solely on automated processing, and we do not carry out profiling of that kind. Any plan we produce is prepared or reviewed by a person.

6. Cookies, tracking and advertising

6.1 Anonymous audience measurement (no consent needed)

We measure how our pages are used — pages viewed, scrolling, clicks and how much of a video is watched — to fix and improve the site. Unless you consent to cookies, this measurement is anonymous: nothing is stored on or read from your device, the identifier that groups one page view together exists only while that page is open, and the data is never linked to you, never combined with other data about you, never used for advertising and never shared with anyone. Our website host also counts how many times each page is sent, per hour, with nothing about who asked. Our legal basis is our legitimate interest in running and improving our website (Article 6(1)(f) GDPR). Individual anonymous records are deleted after 90 days; after that we keep only daily and hourly totals, for no more than 25 months.

6.2 Cookies and advertising (only with your consent)

If you choose Accept, we use first-party cookies and local storage to recognise your visit from page to page, link it to the email you give us when you sign up, and tell whether you watched our videos, so our emails are relevant to you. Our pages also load a tag from our advertising partner Taboola, which records your visit and whether you signed up, started checkout or bought and for how much, so Taboola can measure and improve our ads. Taboola may set its own cookies and processes this data under its own privacy policy. Our legal basis for all of this is your consent (Article 6(1)(a) GDPR, and the ePrivacy rules on cookies). We never send health data to Taboola. We do not use the Meta (Facebook) pixel or Google advertising or analytics tags.

6.3 Your choices

Nothing in 6.2 happens until you choose Accept. No thanks leaves only the anonymous measurement in 6.1. You can withdraw or give consent at any time, as easily as you gave it, from the Your privacy choices link at the foot of every page. Your choice is remembered on your device for 180 days.

6.4 The cookies we use

7. Recipients of your data

  • Processors acting on our instructions — payment processing, website and application hosting, email delivery, video hosting, analytics and advertising measurement, scheduling and support tooling. Each is bound by a data processing agreement under Article 28.
  • Professional advisers — accountant, bookkeeper or lawyers, under a duty of confidentiality.
  • Authorities — where required by law or to prevent a serious threat to a person's life, health or safety.
  • Business transfer — if the business is sold or restructured, data may transfer under terms no less protective.

We do not sell personal data.

8. International transfers

We are established in Australia, and some of our processors operate in the United States and elsewhere. Your personal data is therefore transferred outside the EEA and the UK.

Where we transfer personal data outside the EEA or UK, we rely on one or more of the following safeguards:

  • Standard Contractual Clauses adopted by the European Commission, and the UK International Data Transfer Addendum, incorporated into our contracts with processors;
  • an adequacy decision where one covers the destination;
  • your explicit consent, where applicable and appropriate.

You may request a copy of the safeguards we rely on by emailing support@silencemyears.com.

9. Your rights

Under the GDPR and UK GDPR you have the right to:

  • Access — obtain confirmation of whether we process your data and a copy of it.
  • Rectification — have inaccurate or incomplete data corrected.
  • Erasure — have your data deleted, where we have no overriding lawful ground to keep it.
  • Restriction — have processing restricted in certain circumstances.
  • Portability — receive data you gave us in a structured, commonly used, machine-readable format, and have it transmitted to another controller where technically feasible.
  • Object — object to processing based on legitimate interests, and object to direct marketing at any time, which we will always honour.
  • Withdraw consent — at any time, without affecting prior lawfulness.
  • Not be subject to automated decision-making producing legal or similarly significant effects. As noted, we do not carry this out.

9.1 How to exercise them

Email support@silencemyears.com. We respond within one month, extendable by a further two months for complex requests, and we will tell you within the first month if we need the extension. There is no charge unless a request is manifestly unfounded or excessive. We may need to verify your identity first.

10. Retention

  • Marketing contact details — Until you unsubscribe or request deletion, then only as needed to honour the opt-out
  • Transaction records — At least seven years, for tax and accounting obligations
  • Health and coaching data — As long as needed to provide the service and a reasonable period after, then deleted or de-identified
  • Analytics data — Normally de-identified or aggregated after 26 months
  • Support correspondence — Up to three years after the matter is closed

11. Security

We hold personal data in secure, access-controlled systems, with encryption in transit (HTTPS/TLS), encryption of stored credentials, database-level access controls, and access limited to those who need it.

No system is perfectly secure. Where a personal data breach is likely to result in a risk to your rights and freedoms, we will notify the relevant supervisory authority within 72 hours where required, and notify you without undue delay where the risk is high.

12. Direct marketing

Marketing email is sent on the basis of your consent, or on the soft opt-in basis where you have bought from us and we are marketing similar products. Every message contains an unsubscribe link, honoured promptly. You may object to direct marketing at any time, and we will stop.

13. Children

Our services are directed to adults and not intended for anyone under 18. We do not knowingly process the data of children. If you believe a child has given us data, contact us and we will delete it.

14. Your right to complain

If you are unhappy with how we have handled your personal data, please tell us first at support@silencemyears.com — we take it seriously and would rather fix it.

You also have the right to lodge a complaint with a supervisory authority, in the member state of your habitual residence, place of work, or the place of the alleged infringement:

  • EU — a list of national data protection authorities is at edpb.europa.eu.
  • UK — the Information Commissioner's Office, ico.org.uk, helpline 0303 123 1113.
  • Switzerland — the Federal Data Protection and Information Commissioner, edoeb.admin.ch.

15. Changes to this policy

We may update this policy. When we make material changes we will update the "Last updated" date and, where appropriate, notify you by email or website notice. The current version is always available on our websites.

2. The standard we apply

We are based in Australia and handle personal information in accordance with the Australian Privacy Principles under the Privacy Act 1988 (Cth).

Because our customers are spread across many countries, we apply that standard as a baseline everywhere, and we comply with any additional obligation imposed by the law of your country. Where the law where you live gives you a stronger right than this policy describes, that stronger right applies.

Laws that may apply to you depending on where you live include:

  • New Zealand — Privacy Act 2020
  • Singapore — Personal Data Protection Act 2012
  • Japan — Act on the Protection of Personal Information (APPI)
  • South Korea — Personal Information Protection Act (PIPA)
  • Hong Kong — Personal Data (Privacy) Ordinance
  • Malaysia — Personal Data Protection Act 2010
  • Philippines — Data Privacy Act of 2012

  • Brazil — Lei Geral de Proteção de Dados (LGPD)
  • South Africa — Protection of Personal Information Act (POPIA)
  • UAE — Federal Decree-Law No. 45 of 2021

This list is illustrative, not exhaustive.

3. What we collect

3.1 Information you give us

  • Identity and contact — name, email address, and where provided phone number, country and postal address.
  • Purchase information — products bought, dates, amounts, order references, billing country. Full card numbers are handled by our payment providers and never stored by us.
  • Health information — where you choose to provide it through an intake form, questionnaire, survey, coaching booking or email. This may include the nature and duration of your tinnitus, related symptoms, diagnoses, test results you describe, medications and supplements, diet, sleep, stress and lifestyle factors.
  • Correspondence — emails, support messages, survey responses and coaching notes.
  • Account details — login credentials in encrypted form.

3.2 Information collected automatically

Technical data (IP address, browser, operating system, device type, screen size, language, referring site); usage data (pages viewed, time on page, scroll depth, clicks, video watch time and depth reached, form interactions); marketing data (the campaign, ad or link that brought you to us, including UTM parameters); and email engagement (delivery, opens and link clicks).

3.3 Information from third parties

Aggregated or attributed campaign data from advertising and analytics platforms, and transaction outcomes from payment providers.

4. Why we collect it

  • Deliver what you purchased — Provide access, fulfil orders, support you
  • Personalise coaching and plans — Only using information you choose to give us
  • Customer support and refunds — Answer questions, honour the guarantee
  • Marketing email — Educational content and offers, with opt-out in every message
  • Improve products and content — Understand what helps, in aggregate
  • Measure advertising — Attribute conversions and control ad spend
  • Security and fraud prevention — Protect accounts and detect abuse
  • Legal, tax and accounting — Meet record-keeping obligations

We do not sell your personal information.

Where the law of your country requires consent for any of the above, we obtain it — and where you have given consent, you may withdraw it at any time by contacting us.

5. Health and sensitive information

Most privacy laws treat health information as a special or sensitive category requiring stronger protection. We treat it that way for everyone.

5.1 Collected only with your consent

We collect health information only where you voluntarily provide it. You are never obliged to share it. If you would rather not, you can still buy and use our general educational products.

5.2 Used only for your plan

Solely to prepare and personalise a plan for you, answer your questions accurately, and — in de-identified, aggregated form — understand which approaches help which kinds of people.

5.3 Never used for advertising, never sold

  • We will not sell it.
  • We will not disclose it to advertisers or use it to target advertising.
  • We will not upload it to any advertising platform, including as part of any custom or lookalike audience.
  • We will not share it with your employer, insurer or any third party, except as set out in Section 7 or where you ask us to.

5.4 Not a medical record

Information you give us is used for coaching and education. It is not a clinical record and does not replace records held by your own doctor.

Your choice is remembered on your device for 180 days. Where the law of your country requires us to ask before setting cookies, we ask first, and nothing but anonymous counting happens until you choose Accept.

  • _ft_vid, _ft_sid, _ft_visits, _ft_first — recognise your visit from page to page (unless you opt out or have not accepted where we ask first; 180 days, or the session).
  • _ft_src, _ft_lead — where you came from, and your email once you sign up (unless you opt out or have not accepted where we ask first; 180 days).
  • _ftpos_… — where you stopped a video, so it can resume (unless you opt out or have not accepted where we ask first; until the video ends).
  • Taboola cookies — advertising measurement (unless you opt out or have not accepted where we ask first; set by Taboola).

Most of these are also kept in your browser’s local storage, which has no expiry date and stays until you clear your browsing data. Choosing No thanks or opting out deletes our visitor, source, email and visit-count entries straight away.

7. Who we share with

  • Service providers — payment processing, hosting, email delivery, video hosting, analytics and advertising measurement, scheduling and support. Each acts on our instructions under contract.
  • Professional advisers — accountant, bookkeeper or lawyers, under confidentiality.
  • Legal and safety — where required by law, court order or lawful government request, or where necessary to prevent a serious threat to a person's life, health or safety.
  • Business transfer — if the business is sold or restructured, information may transfer under terms no less protective.

8. Cross-border transfer

We are based in Australia. Our service providers operate in Australia, the United States, the European Union and elsewhere. Your personal information will therefore be transferred to, stored in and processed in countries other than your own, including Australia.

Before disclosing personal information across a border we take reasonable steps to ensure the recipient handles it consistently with the standard in this policy, normally through contractual data-protection commitments with each provider. Where the law of your country requires your consent to a cross-border transfer, your use of the Services and provision of your information constitutes that consent, and you may withdraw it by contacting us — though we may then be unable to provide the Services.

You should be aware that data protection laws in the countries listed above may differ from those in your own.

9. Storage, security and retention

We hold personal information in secure, access-controlled systems, with encryption in transit (HTTPS/TLS), encryption of stored credentials, database-level access controls, and access limited to those who need it.

No system is perfectly secure. Where a breach occurs that is likely to cause serious harm, we will notify affected individuals and any regulator required by the applicable law.

Retention: marketing contact details until you unsubscribe or ask for deletion; transaction records at least seven years for tax and accounting; health and coaching information for as long as needed to deliver the service and a reasonable period after, then deleted or de-identified; analytics data normally de-identified or aggregated after 26 months.

10. Your rights

Wherever you live, you may ask us to:

  • confirm what personal information we hold about you;
  • give you a copy of it;
  • correct anything inaccurate, out of date, incomplete or misleading;
  • delete it, where we are not required by law to keep it;
  • stop sending you marketing, at any time;
  • withdraw consent you have previously given.

Depending on your country you may also have rights to data portability, to object to or restrict certain processing, and to complain to a national regulator. We honour those rights where they apply to you, and we will not discriminate against you for exercising them.

10.1 How to make a request

Email support@silencemyears.com. We respond within a reasonable time and in any event within 30 days, or sooner where your local law requires. We may need to verify your identity first. There is no charge unless a request is manifestly unfounded or excessive, in which case we will discuss any reasonable cost with you before proceeding.

11. Direct marketing

Every marketing email contains a clear unsubscribe link, honoured promptly. You may still receive transactional messages relating to a purchase, such as receipts and access details. You may also opt out at any time by emailing support@silencemyears.com.

12. Anonymity

Where lawful and practicable you may deal with us anonymously or under a pseudonym — for example when asking a general question. We cannot deliver a purchased product, provide personalised coaching or process a refund without identifying information.

13. Children

Our services are directed to adults and not intended for anyone under 18, or the age of majority in your country if higher. We do not knowingly collect personal information from children. If you believe a child has given us information, contact us and we will delete it.

14. Complaints

If you think we have mishandled your personal information, please tell us first at support@silencemyears.com. We take complaints seriously and will investigate and respond, normally within 30 days.

If you are not satisfied, you may complain to the data protection or privacy regulator in your country. If your country has no such regulator, you may complain to the Australian regulator, since we are based in Australia:

Office of the Australian Information Commissioner (OAIC) Website: oaic.gov.au · Phone: +61 1300 363 992 · Post: GPO Box 5218, Sydney NSW 2001, Australia

15. Changes to this policy

We may update this policy. When we make material changes we will update the "Last updated" date and, where appropriate, notify you by email or website notice. The current version is always available on our websites.
